Legal procedural order establishing stay pending federal interpleader resolution
Analytical Summary
This agreed court order from Fairfax County Circuit Court stays a garnishment proceeding (Case No. CL2025-16055) brought by Advanced Navigation & Positioning Corporation against Cyberlux Corporation, with HII Mission Technologies Corp. as garnishee. The stay is granted because HII seeks to deposit disputed funds ($25,769,369.03 less recoupments and setoffs, minus $1,444,543.11 already paid) into federal court in an interpleader action (Civil Action No. 3:25-cv-00483-JAG). The stay continues for 180 days or until HII deposits the disputed funds in the interpleader action, whichever comes first. HII will be discharged from liability if it deposits the funds and is discharged in the federal interpleader action.

CLM-001
Claim
HII indebtedness to Cyberlux calculated as disputed funds
The disputed funds are calculated as the amount HII is indebted to Cyberlux: $25,769,369.03 less recoupment and/or setoff amounts which Cyberlux owes to HII and less $1,444,543.11 paid into court in Case No. CL2025-3413.
Page 2 — The funds are identified in HII's First Amended Complaint for Interpleader as the amount HII is indebted to Cyberlux (the "Disputed Funds"), calculated as $25,769,369.03 less recoupment and/or setoff amounts which Cyberlux owes to HII and less $1,444,543.11 paid into this Court by HII in the garnishment action assigned Case No. CL2025-3413.

Stage 3
In Situ — Quotations, Tells, Tensions, Questions
4 nodes
TEN-001
Tension
Competing claims over disputed funds between ANPC and Cyberlux
ANPC seeks garnishment of funds HII owes to Cyberlux, while HII seeks to deposit those same disputed funds in federal court via interpleader to resolve competing claims from multiple parties including ANPC and Cyberlux.
Page 2 — the funds at issue in this garnishment proceeding are part of funds that Garnishee HII seeks to deposit in the United States District Court for the Eastern District of Virginia in the action brought by HII against Cyberlux, ANPC and others
QST-001
Question
What are the specific recoupment and setoff amounts?
The order references 'recoupment and/or setoff amounts which Cyberlux owes to HII' that reduce the gross amount of $25,769,369.03, but the specific amounts and nature of these offsets are not disclosed in this order.
Page 2 — calculated as $25,769,369.03 less recoupment and/or setoff amounts which Cyberlux owes to HII
QST-002
Question
What is the relationship between Case No. CL2025-3413 and CL2025-16055?
The order references a prior garnishment action (Case No. CL2025-3413) into which HII paid $1,444,543.11, but does not explain the relationship between that case and the current garnishment proceeding (Case No. CL2025-16055).
Page 2 — less $1,444,543.11 paid into this Court by HII in the garnishment action assigned Case No. CL2025-3413
QST-003
Question
Who are the 'others' named in the federal interpleader action?
The order identifies the federal interpleader action as brought 'by HII against Cyberlux, ANPC and others' but does not identify who the additional parties are.

Stage 4
Interpretive — Inferences, Omissions, Patterns

INF-001
Inference
Multiple creditors likely claiming rights to HII-Cyberlux funds
The existence of both a state garnishment action by ANPC and a federal interpleader action naming 'others' beyond ANPC and Cyberlux suggests that multiple parties claim rights to the funds HII owes Cyberlux, prompting HII to seek judicial resolution of competing claims through interpleader.
Page 2 — the action brought by HII against Cyberlux, ANPC and others (Civil Action No. 3:25-cv-00483-JAG) (the "Interpleader Action")
INF-002
Inference
Prior garnishment suggests earlier creditor action
The $1,444,543.11 payment by HII into a prior garnishment action (Case No. CL2025-3413) suggests that another creditor of Cyberlux previously sought garnishment of HII funds, and this amount represents either partial satisfaction or an initial deposit in that earlier proceeding.
Page 2 — less $1,444,543.11 paid into this Court by HII in the garnishment action assigned Case No. CL2025-3413
INF-003
Inference
Cooperative relationship between ANPC and HII in seeking stay
ANPC and HII jointly moved for the stay, suggesting they share an interest in having the federal court resolve the interpleader claims rather than proceeding with state garnishment, despite ANPC being the judgment creditor seeking garnishment.
Page 2 — motion of Judgment Creditor Advanced Navigation & Positioning Corporation ("ANPC") and Garnishee HII Mission Technologies Corp. ("HII" and together with ANPC, the "Agreeing Parties"), requesting the Court stay this garnishment proceeding
OMI-001
Omission
Net disputed funds amount not calculated
While the order provides the gross amount ($25,769,369.03), prior payment ($1,444,543.11), and references to recoupment/setoff amounts owed by Cyberlux to HII, it does not state the net amount of disputed funds that will be deposited in the interpleader action.
Page 2 — calculated as $25,769,369.03 less recoupment and/or setoff amounts which Cyberlux owes to HII and less $1,444,543.11 paid into this Court
OMI-002
Omission
Basis for ANPC's judgment against Cyberlux not disclosed
The order identifies ANPC as 'Judgment Creditor' with Cyberlux as 'Judgment Debtor' but provides no information about the underlying judgment, its amount, or the legal basis for ANPC's claim against Cyberlux.
Page 2 — ADVANCED NAVIGATION & POSITIONING CORPORATION, Judgment Creditor, V. CYBERLUX CORPORATION, Judgment Debtor
OMI-003
Omission
Nature of HII-Cyberlux business relationship not described
The order establishes that HII owes substantial funds to Cyberlux ($25.7M+ gross) and that Cyberlux owes recoupment/setoff amounts to HII, but does not describe the underlying business relationship, contract, or transaction basis for these mutual obligations.
Page 2 — the amount HII is indebted to Cyberlux (the "Disputed Funds"), calculated as $25,769,369.03 less recoupment and/or setoff amounts which Cyberlux owes to HII

AGREED ORDER ON PARTIALLY JOINT MOTION TO STAY

This matter is before the Court on the motion of Judgment Creditor Advanced Navigation & Positioning Corporation ("ANPC") and Garnishee HII Mission Technologies Corp. ("HII" and together with ANPC, the "Agreeing Parties"), requesting the Court stay this garnishment proceeding (the "Motion"). In the Motion, the Parties request a stay, in part, because the funds at issue in this garnishment proceeding are part of funds that Garnishee HII seeks to deposit in the United States District Court for the Eastern District of Virginia in the action brought by HII against Cyberlux, ANPC and others (Civil Action No. 3:25-cv-00483-JAG) (the "Interpleader Action"). The funds are identified in HII's First Amended Complaint for Interpleader as the amount HII is indebted to Cyberlux (the "Disputed Funds"), calculated as $25,769,369.03 less recoupment and/or setoff amounts which Cyberlux owes to HII and less $1,444,543.11 paid into this Court by HII in the garnishment action assigned Case No. CL2025-3413.

For good cause shown, and with the consent of Plaintiff ANPC and Garnishee HII, the motion is GRANTED as follows:

1.
This case is hereby STAYED subject to the Interpleader Action.
2.
The stay shall continue for a period of one hundred and eighty (180) days after entry of this Order OR until the deposit of the Disputed Funds by HII in the Interpleader Action whichever comes first.
3.
The Parties agree that HII will be discharged from any liability in this action if: (1) HII deposits the Disputed Funds in the Interpleader Action; and (2) HII is discharged in the Interpleader Action. Upon the occurrence of those two events, the parties will submit a proposed final order acknowledging HII's discharge in the Interpleader Action and in this garnishment action.
4.
Upon the conclusion of the stay created by paragraph 1 above, the Parties shall report back to the Court and seek further relief or guidance, as necessary, or submit an appropriate order.

This the day of January, 2026.
