AGREED ORDER ON PARTIALLY JOINT MOTION TO STAY

This matter is before the Court on the motion of Judgment Creditor Advanced Navigation & Positioning Corporation ("ANPC") and Garnishee HII Mission Technologies Corp. ("HII" and together with ANPC, the "Agreeing Parties"), requesting the Court stay this garnishment proceeding (the "Motion"). In the Motion, the Parties request a stay, in part, because the funds at issue in this garnishment proceeding are part of funds that Garnishee HII seeks to deposit in the United States District Court for the Eastern District of Virginia in the action brought by HII against Cyberlux, ANPC and others (Civil Action No. 3:25-cv-00483-JAG) (the "Interpleader Action"). The funds are identified in HII's First Amended Complaint for Interpleader as the amount HII is indebted to Cyberlux (the "Disputed Funds"), calculated as $25,769,369.03 less recoupment and/or setoff amounts which Cyberlux owes to HII and less $1,444,543.11 paid into this Court by HII in the garnishment action assigned Case No. CL2025-3413.

For good cause shown, and with the consent of Plaintiff ANPC and Garnishee HII, the motion is GRANTED as follows:

1.
This case is hereby STAYED subject to the Interpleader Action.
2.
The stay shall continue for a period of one hundred and eighty (180) days after entry of this Order OR until the deposit of the Disputed Funds by HII in the Interpleader Action whichever comes first.
3.
The Parties agree that HII will be discharged from any liability in this action if: (1) HII deposits the Disputed Funds in the Interpleader Action; and (2) HII is discharged in the Interpleader Action. Upon the occurrence of those two events, the parties will submit a proposed final order acknowledging HII's discharge in the Interpleader Action and in this garnishment action.
4.
Upon the conclusion of the stay created by paragraph 1 above, the Parties shall report back to the Court and seek further relief or guidance, as necessary, or submit an appropriate order.
